Novartis contre l'Inde
In developing countries, access to essential drugs is far from being a right. Aids, TB and malaria claim thousands of victims daily and the fear of rising drug prices prevails. Providing the backdrop: a court battle pitting the Novartis pharmaceutical company against India, leading producer of generic drugs.Last August 6, Novartis lost its legal battle against India. The object of the battle: the patents of brand-name drugs, which India only recognizes under certain terms. But the case is not closed. Other court decisions are due. On the one hand, they reflect the interest of pharmaceutical giants for the Indian market, and on the other, the fears of humanitarian players and southern countries over access to affordable essential drugs, generic Indian drugs for the most part.
